There is generally a schedule in which an individual is compensated, depending on their injuries and level of impairment as set forth by the American Medical Association. At times, there may be two distinctly separate cases involving an injury sustained while working. If a plaintiff is injured at work by a third party who is not a co-employee, the plaintiff may be able to recover from their employer and the individual defendant.

In third party liability cases, the plaintiff often realizes a greater level of compensation if negligence of a third party is proven. In a worker's compensation case, negligence of a third party need not be proven. An injury could stem from the negligence of the injured plaintiff and they may still be able to recover.
